1. Acceptance of Terms
These Terms of Service ("Terms") govern access to and use of the Street IT Compliance Portal (the "Portal").
By accessing or using the Portal, you agree to be bound by these Terms. If you do not agree to these Terms, you must discontinue use of the Portal.
2. Portal Purpose
The Portal is provided by Street IT Consulting Services LLC for authorized clients and approved users to access:
Data destruction certificates
Media sanitization records
Compliance documentation
Service records
Asset-related documentation
Other authorized files and records
Access is restricted to authorized users approved by Street IT Consulting Services LLC or the client organization.
3. User Accounts
Users are responsible for:
Maintaining the confidentiality of account credentials
Ensuring account information remains accurate
Preventing unauthorized use of their account
Promptly notifying Street IT Consulting Services LLC of suspected security incidents
Users may not share credentials with unauthorized individuals.
4. Authorized Use
Users may use the Portal only for legitimate business purposes related to services provided by Street IT Consulting Services LLC.
Users agree not to:
Access information they are not authorized to access
Attempt to bypass security controls
Interfere with Portal operations
Upload malicious software or code
Reverse engineer Portal functionality
Use automated tools to scrape data
Violate applicable laws or regulations
5. Ownership and Intellectual Property
All software, designs, workflows, templates, branding, and Portal functionality are the property of Street IT Consulting Services LLC unless otherwise stated.
Clients retain ownership of their business records and information submitted or generated through services provided by Street IT Consulting Services LLC.
Nothing in these Terms transfers ownership of intellectual property belonging to either party.
6. Compliance Records and Certificates
Certificates, reports, and compliance documentation provided through the Portal reflect information available at the time services were performed.
Clients remain responsible for:
Reviewing documentation
Maintaining required records
Meeting regulatory obligations
Retaining records according to their own policies and requirements
Street IT Consulting Services LLC makes reasonable efforts to ensure documentation accuracy but does not guarantee that records are free from errors caused by information provided by third parties or clients.
7. Availability
Street IT Consulting Services LLC makes reasonable efforts to maintain Portal availability.
However, the Portal may become unavailable due to:
Scheduled maintenance
Software updates
Security incidents
Third-party service interruptions
Events beyond our reasonable control
No guarantee of uninterrupted availability is provided.
8. Disclaimer of Warranties
THE PORTAL IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREET IT CONSULTING SERVICES LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREET IT CONSULTING SERVICES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
THIS INCLUDES, WITHOUT LIMITATION:
LOSS OF PROFITS
LOSS OF REVENUE
LOSS OF BUSINESS OPPORTUNITY
LOSS OF DATA
BUSINESS INTERRUPTION
IN NO EVENT SHALL THE TOTAL LIABILITY OF STREET IT CONSULTING SERVICES LLC EXCEED THE TOTAL AMOUNT PAID BY THE CLIENT TO STREET IT CONSULTING SERVICES LLC FOR THE SERVICES DIRECTLY RELATED TO THE CLAIM DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
10. Suspension and Termination
Street IT Consulting Services LLC may suspend or terminate access to the Portal at any time for reasons including:
Security concerns
Violations of these Terms
Termination of service agreements
Legal or regulatory requirements
Protection of Portal operations
Termination of access does not eliminate any obligations that arose prior to termination.
11. Indemnification
Users agree to indemnify, defend, and hold harmless Street IT Consulting Services LLC, its owners, employees, contractors, and representatives from claims, damages, losses, liabilities, and expenses arising from:
Violations of these Terms
Unauthorized use of the Portal
Violations of applicable law
Misuse of records or documentation obtained through the Portal
12. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Kansas, without regard to conflict of law principles.
Any dispute arising under these Terms shall be brought exclusively in a court of competent jurisdiction located within the State of Kansas.
13. Modifications
Street IT Consulting Services LLC may modify these Terms at any time.
Updated Terms become effective upon publication within the Portal unless otherwise stated.
Continued use of the Portal constitutes acceptance of the revised Terms.
